Nearby Right Now is operated as an independent project from the State of Maryland, United States. In these Terms, "we", "us" and "the site" mean that operator, and "you" means the person using it. You can reach us at [email protected].

By creating an account, or by using the site without one, you agree to these Terms. If you do not agree, do not use the site.

1. You must be 21 or older

You must be at least 21 years old to use Nearby Right Now. By using it you confirm that you are. We do not knowingly let anyone under 21 hold an account, and we will close an account we believe belongs to a minor.

This is not a formality. Nearby Right Now exists to introduce adults who may then meet in person, and that is not something we will do with minors involved.

2. Your account

There are no passwords. You sign in with a short code we email you. That means anyone who can read your email can sign in as you, so keep your mailbox secure and tell us at once if you think someone else has access to your account.

One account per person. Do not create an account for someone else, do not impersonate anyone, and do not sell or transfer your account. You are responsible for what happens through it.

3. What you may not do

Do not use Nearby Right Now to:

  • harass, threaten, stalk, defraud or deceive anyone;
  • post anything unlawful, or anything sexual involving minors;
  • post another person's private information, or an intimate image of anyone who has not agreed to it being posted;
  • impersonate a person or organisation, or misrepresent your age, identity or affiliation;
  • advertise, solicit, run a scam, or ask other users for money;
  • scrape, crawl or bulk-collect data or other users' information;
  • break, overload, probe or reverse-engineer the site, or try to reach data or accounts that are not yours;
  • use the site if we have already closed an account of yours.

We may remove content that breaks these rules and may suspend or close accounts. Where a report suggests a crime, we may report it to the police.

4. What you post, and what we can see

You keep ownership of the photos, text and messages you post. You give us a non-exclusive licence to store, copy, display and transmit that content so the site can work -- showing your photo on your profile, and delivering your message to the person you sent it to. That licence ends when you delete the content or your account, except where we must keep something for a legal reason.

You are responsible for what you post. Do not post anything you do not have the right to post.

Your messages are private in the sense that we do not publish them. They are not end-to-end encrypted. We can read them when we have a reason to -- to investigate a report of abuse, or where the law requires it. Do not send anything through Nearby Right Now you would not want a member of our team to be able to read.

5. Other people, and meeting them

We do not run criminal background checks, and we do not confirm that anyone is who they claim to be beyond the specific checks described below. A verification badge tells you one narrow thing. It is not a character reference and not a guarantee of anyone's intentions.

Other users' behaviour is their own, and you meet people at your own risk. Take the precautions you would take meeting any stranger: meet in public, and tell someone where you are going.

If someone behaves badly, report and block them. You can also write to [email protected].

6. Verification badges

We offer two. SMS Verified means the person controls a phone number, checked by our provider, Twilio; it filters out casual spam and does not prove who they are. ID Verified means the person showed a government identification document and a live face video to our provider, Didit; it does not prove that the name they give you is the name on that document, and it does not prove good intentions. Each badge on a profile links to an article explaining exactly what it does and does not prove. Read it before relying on a badge.

7. Payments, and what is real right now

During this beta, no payment on this site is real. The payment system is a simulator. It is switched off, nothing is charged, and no money changes hands. Any credit balance, purchased slot or voucher value you see is a demonstration.

When real payments are switched on, this page will say so, these Terms will be updated, and the price, currency and refund position will be stated before you buy anything. Until then, do not expect anything money-shaped here to have value, and do not send us or anyone else money for it.

8. This is a beta

Nearby Right Now is unfinished software that we are running in public on purpose. It can change, break, or lose data. Features may be withdrawn. Your data may be reset while we work on it. We do not promise that the site will be available at any particular time.

9. Closing your account

You may stop using the site at any time. In Settings you can delete your account. Deletion takes effect immediately: you are signed out, and your profile and cards leave the site. We keep the account record for 30 days, then delete the profile, photos, messages and the account. Signing in again during those 30 days cancels the deletion and restores the account. A report someone else filed, or a record the law requires us to keep, can remain after that.

You can also write to [email protected].

We may suspend or close your account if you break these Terms, if we are required to, or if we stop operating the site.

10. Our responsibility to you

The site is provided as it is. To the extent the law allows, we exclude all warranties, and we are not liable for indirect or consequential losses, for loss of data, or for what another user does. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

Where we are liable, our total liability to you is limited to the greater of the amount you have paid us in the twelve months before the claim, and USD 50.

11. Changes to these Terms

We may change these Terms. If a change is significant we will make it visible on the site -- the date at the bottom changes, and where the change matters we will point it out rather than relying on you to notice. Continuing to use the site after a change means you accept it.

12. Which law applies

These Terms are governed by the laws of the State of Maryland, United States, and disputes will be heard in the courts there. If a court finds part of these Terms unenforceable, the rest still applies.
